Q. Will I be responsible
for anything if we lose?
A. If we are unsuccessful in prosecuting your
case, you will not be responsible for any of the costs incurred. You
only become responsible for costs if we win the case. All costs will
be deducted from the case proceeds.

How much will it cost to prosecute the case?
A. Even though the costs involved with a case
can run anywhere form $10,000 to $165,000 and up, it costs you nothing,
unless there is a recovery. Castiglia-Rubinstein & Associates
will advance the costs of the litigation and charge you nothing unless
a settlement or judgment is collected.
Q. How does Castiglia-Rubinstein & Associates get paid?
A. Our legal fees come from a percentage of
the total amount of benefits we recover from your insurance company
on your behalf. In most cases, however, we are able to require the
insurance company to pay our legal fee in addition to also paying
your benefits. If the amount of the court ordered fee equals or exceeds
the contingency fee, then you will receive all your benefits without
any portion being deducted for legal expenses.

What is a mediation?
A. A mediation is a settlement conference which
takes place prior to a case proceeding to trial. Each side appears
with their lawyer and appears before a person known as a mediator.
A mediator is often a retired judge or lawyer. All information contained
in the mediation conference is confidential and can not be used. If
the parties are unable to settle the case during the mediation, the
the case proceeds to trial.
Q. How long will it take to resolve my case?
A. The answer to this question can vary greatly
depending on the complexity of the case. For instance, the typical
medical malpractice case can take between 1 and 2 years from the date
the complaint is filed to get resolved, but the average auto premises
liability / auto case or any other type of general negligence case,
is typically resolved within 4 to 8 months.
